Terms of Use

1. Agreement

Speakness is provided by AZ Labs Limited, a company registered in New Zealand (“AZ Labs”, “we”, “us”). By creating an account or using Speakness, you agree to these terms and to our Privacy Policy.

If you got Speakness from the App Store, Apple’s Standard Licensed Application End User License Agreement (the “Apple EULA”) also applies. If these terms conflict with the Apple EULA, the Apple EULA applies to that conflict. Apple is not responsible for Speakness or its content.

2. Eligibility and accounts

You must be at least 13 to use Speakness. If you are under the age of majority where you live, you need a parent or guardian’s permission. You are responsible for the activity on your account and for keeping your sign-in details secure. Tell us at hello@speakness.app if you think someone else has accessed your account.

3. Subscriptions and free trials

Some or all of Speakness requires a Speakness Pro subscription, offered monthly or yearly through Apple’s In-App Purchase.

• Price. The price, currency and any taxes are shown on the subscription screen and in the App Store before you buy. Apple sets regional pricing.
• Free trial. If you are eligible, your subscription starts with a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription and you are charged. Any unused part of a free trial ends when you buy a subscription.
• Payment. Payment is charged to your Apple Account when you confirm the purchase, or at the end of the free trial.
• Auto-renewal. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
• Managing and cancelling. You can manage or cancel your subscription in your Apple Account settings, or from Settings → Manage subscription in the app. Cancelling stops future renewals; you keep access until the end of the period you have paid for.
• Refunds. Apple handles all billing and refunds. To request a refund, visit reportaproblem.apple.com.
• Price changes. If the price changes, Apple will tell you in advance and, where required, ask you to agree before you are charged the new price.

Deleting the app or your account does not cancel your subscription.

4. Your content

You own your recordings, answers and other content you create in Speakness. You give us a limited licence to store, transcribe and analyse that content, and to send it to our service providers, only so we can provide Speakness to you. This licence ends when your content is deleted, except for copies in backups that expire on their own schedule. Our Privacy Policy explains how we handle it.

Don’t record other people without their permission.

5. AI feedback

Speakness uses automated speech recognition and AI models to produce transcripts, measurements, reviews, suggestions and practice questions. These can be inaccurate or incomplete. They are for practice and self-improvement only. They are not professional, medical, speech-therapy, legal or employment advice. Use your own judgement before relying on them.

6. Acceptable use

You agree not to:

• break the law or infringe anyone’s rights while using Speakness;
• upload content that is unlawful, harassing, or that you have no right to share;
• try to access other users’ data, or probe, disrupt or overload our systems;
• copy, modify, reverse engineer or resell the app, except where the law allows; or
• use automated means to access Speakness, or use it to build a competing product.

7. Our intellectual property

Speakness, including its software, design, questions and written guides, belongs to AZ Labs or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, under these terms and the Apple EULA.

8. Changes to the service

We keep improving Speakness, so features may change, be added or be removed. If we stop offering Speakness entirely, we will give you reasonable notice where we can.

9. Ending your use

You can stop using Speakness at any time and ask us to delete your account at hello@speakness.app. We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal reasons. Sections 4, 7, 10 and 11 continue to apply after your use ends.

10. Disclaimers and liability

We work to keep Speakness available and accurate, but we provide it “as is” and do not promise it will be uninterrupted, error-free or suited to every purpose.

Nothing in these terms limits rights you have under consumer law that cannot be excluded, such as the New Zealand Consumer Guarantees Act 1993 or the Australian Consumer Law.

To the extent the law allows, AZ Labs is not liable for indirect or consequential loss, or for loss of data, profits or opportunity. Our total liability to you for any claim is limited to the amount you paid for Speakness in the 12 months before the claim, or NZ$50 if you have not paid anything.

11. Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction. If you live elsewhere, you also keep any protections the laws of your country give you.

12. Changes to these terms

We may update these terms. We will change the date at the top. If a change is material, we will tell you in the app before it takes effect. If you keep using Speakness after that, the new terms apply.
